Harekrushna
Mahtab State Library
- These rules may be
called the Harekrushna Mahtab State Library
- In these rules, unless
the context, otherwise requires-
(a)
“Director” means the Director of the Harekrushna Mahtab
State Library
- The Harekrushna Mahtab
State Library is a Reference and Research Library and shall not
lend out any material for use outside the premises of the State
Library.
- The Library shall only
be open to registered members of the State Library and such
casual visitors as are permitted by the Director of the State
Library (hereinafter referred to as the Director) under Rule 10.
- Subject to the
provisions of these Rules, any person above the age of 18 years
who in consideration of his or her educational status and
interest, is in the opinion of the Director, in a position to
profitably utilize the facilities offered by the State Library,
may, on application, be enrolled as a member of the State
Library:
- A person desiring to be
a member of the State Library shall make an application in the
appropriate form appended to these Rules, obtainable on payment
of Rupees five, together with two copies of the latest passport
size photographs of the applicant and the receipt in support of
payment of application fee. The Director may, where he considers
it necessary, require any applicant, about whose eligibility
there is any doubt, to produce evidence in support of his
eligibility for membership and the application shall not be
deemed to be complete until such evidence has been produced. An
application which is not complete in all respects shall not be
taken into consideration.
- The Director shall have
the right to reject any application for membership without
communicating any reason therefore and the Director’s decision
in such cases shall, subject to review by the Director, Culture,
Government of Orissa, be final.
- Every person admitted as
a member of the State Library shall be required to make a
refundable deposit of Rs.50 before issue of Membership Card to
the applicant.
- Membership of the State
Library shall ordinarily remain valid for a period of three
years from the date of issue of the Membership Card and on
application by the member may be renewed for further periods not
exceeding three years at a time. Rules and procedure relating to
enrolment of members shall mutatis mutandis apply to
applications for renewal of membership.
- Membership Cards are not
transferable. Members shall be responsible for the safe custody
of Membership Cards issued to them and shall also be liable for
any misuse of the card by any other person. Loss of Membership
Card shall be reported forthwith. In the event of loss or
damage, a duplicate card may be obtained on submission of
application accompanied by two passport size photographs of the
applicant and un payment of Rupees five.
- A member of the State
Library shall be entitled to use the Bhubaneswar Public Library
at its premises but shall not be entitled to borrow books from
the Bhubaneswar Public Library except in accordance with Rules
Governing the use or the Bhubaneswar Public Library.
- The Director may, on
application in the prescribed form obtainable on payment of
Rs.3, permit a casual visitor to make use of the facilities
offered by the State Library at it’s premises for a period not
exceeding 30 days in a calendar year.
- Casual visitors desiring
to use the facilities of the State Library for more than seven
days, but not exceeding 30 days shall be required to make a
refundable deposit of Rs.30.
The
Bhubaneswar Public Library
- The Bhubaneswar Public
Library is a branch of this State Library and functions as a
reference and lending library. It shall only be open to the
registered members of the State Library, to the Members of the
Bhubaneswar Public Library and such casual visitors as are
permitted by the Director under Rule 18.
- Subject to the
provisions of these rules, any person above the age of 12 years
who, in consideration of his or her educational qualification
and interest, is in the opinion of the Director, in a position
to profitably utilize the facilities offered by the Bhubaneswar
Public Library, may on application, be enrolled as a member of
the Bhubaneswar Public Library:
Provided that every member of the State
Library shall be deemed to be a Member of the Bhubaneswar Public
Library:
Provided further that a Member of the State
Library or a Member of the Bhubaneswar Public Library shall not be
permitted to use the Children’s Section of the Bhubaneswar Public
Library.
- Any person desiring to
be a Member of the Bhubaneswar Public Library shall make an
application in the appropriate form appended to these Rules
obtainable on payment of Rupees five together with two copies of
the latest passport-sized photographs of the applicant and the
receipt in support of payment of application fee. The Director
may, in his discretion, require any applicant about whose
eligibility there is any doubt, to produce evidence in support
of his eligibility for membership and an application shall not
be deemed to be complete until such evidence has been produced.
An application which is not complete in all respects shall not
be taken into consideration.
- The Director shall have
the right to reject any application for membership without
communicating any reason therefore and the Director’s decision
in such cases shall, subject to the review by the Director,
Culture, Government of Orissa, be final.
- Any person who is a
member of the Bhubaneswar Public Library or is deemed to be a
member of the said library under Rule 13 may, subject to the
provisions of these rules, be permitted to borrow books after
the member has made a refundable deposit of Rs.50.00 or
Rs.100.00 or Rs.150.00. A member who has made a deposit of a
lower value may at his option enhance the amount of deposit to
any of the higher amounts from time to time. No book of a value
which is twice the amount of the refundable deposit of the
member shall be given on loan to the member:
Provided that the refundable deposit made
by a Member of the State Library under Rule 8 shall also be deemed
to be a deposit for the purpose of this rule and may be enhanced to
Rs.50.00 or 150.00 at the option of the concerned Member of the
State Library.
- Every Member who is
granted permission to borrow books shall be given a borrower’s
ticket and such Member shall be entitled to borrow one book at a
time against the borrower’s ticket. One volume of a set shall
be deemed to be one book for the purpose of these rules.
- The Director may, on
application in the prescribed form obtainable on payment of
Rs.3.00 permit casual visitors to make use of the Bhubaneswar
Public Library on its premises for a period not exceeding 7 days
at a time and not exceeding 30 days in a calendar year. The
facilities of lending library shall not be open to the casual
visitors.
- Membership Card and
Borrower’s Ticket shall ordinarily remain valid for a period
of three years from the date of issue of the Membership Card and
may be renewed on application for further periods not exceeding
three years at a time. Rules and procedure relating to enrolment
of members and issue of Borrower’s Ticket shall, mutatis
mutandis, apply to application for renewal.
- Membership Card and the
Borrower’s Ticket are not transferable. Members shall be
responsible for the safe custody of the Membership Card and the
Borrower’s Ticket and shall also be liable for misuse of the
card and the ticket issued to them. Loss of Membership Card or
the Borrower’s Ticket shall be reported forthwith. In the
event of loss or damage, a duplicate Membership Card may be
obtained on submission of an application accompanied by two
passport size photographs and on payment of Rupees five. If a
Borrower’s Ticket is lost, a duplicate ticket may be obtained
on payment of Rs.5.00 and signing an indemnity bond to the
effect that the borrower shall be responsible for any book if
issued against the lost ticket.
- Members desiring to
borrow books shall be required to present their Membership Card
and the Borrower’s Ticket at the Circulation Desk. Members may
be permitted to borrow books through their agents by sending
their Membership Card, their Borrower’s Ticket and a letter of
authority under their signature. The letter of authority shall
contain the signature of the agent duly attested by the member
concerned. The Director shall be competent to refuse permission
to borrow through an agent in case of any doubt.
- A member shall be
required to deposit the Borrower’s Ticket at the time of
borrowing a book. The Book Card already inserted in the book
pocket of the book shall be coupled with the Borrower’s Ticket
and this shall be considered sufficient proof of a borrower
having borrowed the book. If the Borrower’s Ticket is in the
possession of the library, it shall be deemed that the member
concerned has borrowed the book, the particulars of which are
recorded on the Book Card. As soon as a book which has been
borrowed is returned, the Borrower’s Ticket shall be returned
back to the member concerned.
- Books on loan shall be
returned within 14 days of their issue or by the due date
stamped on the book, whichever is earlier. A book on loan may be
renewed for a further period not exceeding 7 days beyond the
initial period of loan if the book has not been demanded or
reserved by any other member. Any book already lent out, may be
recalled at any time by the Director without assigning any
reason thereof.
- Before leaving the
counter, the member shall satisfy himself/herself as to whether
the book lent to him is in sound condition and if not shall
immediately bring the matter to the notice or the Director or
the officer of the library in-charge of circulation desk.
Otherwise he or she shall be held responsible for the
replacement of the book if any defect or damage is detected at
the time of return.
- If a book is not
returned to the library when due, an overdue charge of 25 paise
per day including holidays, shall be charged per book and any
liability incurred by a member on account of over retention of
the book must be discharged before the book on loan is returned
or any other book is issued. Habitual over-retention of books
may lead to the suspension or cancellation of the Borrower’s
Ticket by the Director.
- If a book is not
returned within 30 days from the date due, the cost of
replacement of the book and the overdue charges may be
deducted/adjusted from the deposit of the borrower and the
Borrower’s Ticket shall be cancelled after giving due
opportunity of being heard. A demand notice shall be issued for
the balance amount’ if any and in case of default in payment
within the period specified in the notice, a civil suit may be
filed for recovery of the said balance amount with such costs
and interest as may be awarded by the court.
- Any book in the stock of
the library except fiction may be reserved for a Member with a
Borrower’s Ticket on the written request of the Member, Book
so reserved shall be notified on the Notice Board of the
Library. But no such book shall be reserved for more than three
days after the notice has been posted on the Notice Board.
Children
Section of the Bhubaneswar Public Library
- The Children Section of
the Bhubaneswar Public Library has a reading room and a lending
library. The reading room in the Children Section shall be open
to all children in the age-go-up of 5 to 12 years. But the
lending library shall only be open to a member. Application for
membership of the lending library shall be made by the parent of
guardian of the child in the appropriate form appended to these
Rules, available on payment of Rs.5.00. Every member shall be
required to make a refundable deposit of Rs.25.00 before a
Membership Card is issued.
- Membership shall
ordinarily be valid for a period of three years and may, subject
to the restrictions of age, be renewed on application for a
further period not exceeding three years at a time. Rules and
procedures relating to enrolment of member shall mutatis
mutandis apply to applications for renewal.
- A member of the Children
Section shall be allowed to borrow two books from the section at
a time. Books on loan shall be returned within 14 days of their
issue or by the due date stamped on the book whichever is
earlier. If a book is not returned to the library when due, an
overdue charge of 10 paise per volume per day including holidays
shall be levied and if a book is not returned within 30 days of
the due date, the cost of replacement of the volume and overdue
charge shall be deducted adjusted from the deposit and the
balance, if any, shall be recoverable from the parent/guardian
as laid down under Rule 26.
- The parent/guardian
applying for membership shall be responsible for ensuring
compliance to the provisions of these rules by their
children/ward and shall also be responsible for any damage or
loss caused by the children/ward concerned. Provisions of Rules
20,21,22, and 24 shall mutatis mutandis apply to the
Children’s Section with the modification that the
parents/guardians of members may be required to discharge the
liability and responsibility of members of the Children’s
Section.
- Admission to the State
Library and the Bhubaneswar Public Library including it
Children’s Section shall only be open during working hours,
which shall be notified by the Director from time to time with
the approval of Department of Culture, Government of Orissa
provided that the Director may alter the notified working hours
or may close one or more sections of the Library temporarily
without any advance notice for special reasons which he shall
report to the Department of Culture, Government of Orissa. All
users of the library shall vacate the library building at least
five minutes before the closing time. The counter for issue of
books shall be closed fifteen minutes before the closing time of
the lending Departments of the Bhubaneswar Public Library and
its Children’s Section.
- Persons who appear to be
of unsound mind or under the influence of intoxication or
suffering from any infectious disease shall not be admitted into
the Library. Where any such person has gained admission into the
Library, the Director or any other officer of the Library may
remove or cause to be removed such person from the Library.
Where the Director or any other officer of the Library has
reasonable grounds to believe that any property of the Library
is in unlawful possession of any person, such officer may carry
out a body search and search of his belongings if any, while the
person is entering or leaving or present on the premises of the
Library and such person shall provide reasonable assistance for
the search.
- Silence shall be
observed in the Library at all times and it shall be the duty of
every person using or working in the Library to conduct
himself/herself in such a manner as not to cause disturbance,
inconvenience or annoyance to any other person in the legitimate
use of the library.
- Spitting, sleeping and
throwing little are strictly prohibited. Smoking and partaking
of refreshments, except in areas that may be specifically
provided for the purpose are also strictly prohibited.
- No stick, umbrella, box,
bag, container, fire arms, ammunition, inflammable or explosive
substances, articles or substance capable of causing injury or
damage to person or property, books, journals or any printed
material in loose or bound form, briefcases and other
receptacles shall be allowed inside the premises of the Library.
Personal effects may, however, be deposited at the owner’s
risk in a counter provided for the purpose and a token obtained.
The Library shall not, however, accept any liability for any
loss or damage done or caused to any property left at the
aforesaid counter.
- No wheeled vehicle or
conveyance shall be brought into any part of the Library
building. These may, however, be parked at such places as may be
provided for the purpose at the risk of the owners or users
concerned.
- No person shall write
upon, damage, disfigure, displace or mark upon any book,
manuscript, map, document or any other material or property
belonging to the Library. The members making use of books or
other properties of the Library shall be liable for any damage
done or loss caused and shall in addition to such other action
as may be permissible under the law be required to replace the
books or other properties so damaged, forthwith, or pay the cost
of replacement thereof as assessed by the Director. If one book
of a set is damaged or lost, the person responsible shall be
liable to replace the whole set or pay the cost of replacement
thereof as assessed by the Director.
- No person shall make a
tracing of any portion or any book or document or make any
reproduction in any manner without express permission of the
Director or any other officer of the Library authorized by the
Director in his behalf.
- Members shall return to
the Reference Assistant all books, manuscripts, maps, documents,
etc, specially requisitioned for consultation, before they leave
the Library.
- The members shall be
responsible for intimating to the Director of the Library
forthwith any change in any information, address or particulars
furnished in the application for Membership.
- Subject to deduction for
loss or damage caused by the member and any other due payable by
the member, the refundable deposit may be withdrawn at any time
after one month of the date of deposit provided that a notice of
intention to withdraw the deposit has been given 7 clear working
days in advance, Membership Card and Borrower’s Ticket have
been surrendered and all books on loan to the member have been
returned. The Director may at his discretion, waive or reduce
the period of notice prescribed under this Rule. Any deposit not
claimed within six months of cessation of membership, for any
reason whatsoever, shall lapse and no claim for refund shall be
entertained thereafter.
- The Director may cancel
the membership of a member and debar him from future enrolment
as member for a period not exceeding two years if such member
violates or persists in violating the provisions of these rules
after being cautioned or acts in any manner prejudicial to the
interest of the users of the library or to the proper
functioning of the Library.
Provided that no membership shall be
cancelled or a member be debarred from future enrolment until a
notice has been served on the member concerned and the member
concerned has been given an opportunity to show cause against the
proposed action and an enquiry has been held either by the Director
or by any other officer authorized by him.
- The
Director may suspend the membership of any member who has been
served with a notice to show cause under Rule 45 and the period
of suspension shall not ordinarily extend beyond a period of
more than 45 and the period of suspension shall not ordinarily
extend beyond a period of more than 45 days from the date the
reply to the show cause notice was received by the Director from
the member concerned.
- Any member aggrieved by
the decision of the Director under Rule 45 or 46 may file an
appeal before the Director, Culture, Government of Orissa,
within 30 days from the date of communication of the order
against which appeal is proposed to be filed and subject to the
order in the appeal, the orders of the Director shall be final
and binding.
- A notice for showing
cause or any other order made under Rules 45, 46 and 47 may be
delivered personally or be sent by Registered post
acknowledgement due or under certificate of posting to the
postal address given by the member in his application for
membership and the postal receipts shall be deemed to be proof
of sufficient service.
- These rules may be
amended by the Government in the Department of Culture,
Government of Orissa at any time and the amendment shall come
into force from such date as may be indicated by Government in
the order. These rules as amended from time to time shall apply
to all users and members of the Library including those enrolled
as members or permitted to use the Libraries as casual visitors
prior to such amendment.
